SHORT-TERM RENTAL AGREEMENT. You must READ & AGREE before booking, the Short-Term Rental Agreement ("Agreement"). Checking the box above the "book" button indicates you agree to the terms.

LONG-TERM RENTAL AGREEMENT. Below, this marked section applies to Long-Term (28 days+) Stays ("Extended Agreement"), and must be SIGNED & RETURNED to TheWestWoodHaus@gmail.com or faxed to 615-297-0523 prior to a long-term stay.

THE PARTIES. This Short-Term Rental Agreement (“Agreement”) made on dates booked between the Named Guest who Books the Suite (“Guest”), and the Host, WestWood Haus Realty, LLC (“Host”).
THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:
Mailing Address at WestWood Shed, 2604 WestWood Drive, Nashville, TN (Suite number as selected and confirmed after booking.
Hereinafter known as the “Premises.”
LEASE TERM. The Guest shall be allowed to occupy the Premises starting from 3 PM Check-In (date confirmed in booking) and ending at 11 AM Check-Out on the date specified in the booking confirmation (“Lease Term”).
QUIET HOURS. The City of Berry Hill Quiet Hours begin at 9:00 PM each night and continue until 7:00 AM. Quiet hours consist of keeping all audio at a minimum level out of respect for the surrounding residents. The WestWood Shed guests and visitors must follow the City of Berry Hill code ordinances regarding conduct and noise posted in the binder in each Suite -- there you will find details about quiet hours, disturbing the peace, & anti-noise regulations.
OCCUPANTS. The total number of individuals staying on the Premises during the Lease Term shall be a total of {{number_of_guests}} guests. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host.
BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process.
UTILITIES. The Host shall be responsible for all utilities (water & electric) and services (Internet service) to the Premises. If it is determined that an excessive usage of utilities has been incurred by the Guest, additional fees will be charged.
PETS. There are no pets allowed on the Premises. The Host does not allow pets, with the exception of guide animals, and service animals are not allowed without approval of the Host. If at any time there is a complaint about the Guest(s) service animal or the service animal threatens to injure anyone on the premises or the service animal is not secure by a leash and the Guest(s), then the Guest(s) is in violation of this Agreement and the Agreement may be terminated by the Host. If the Guest is found to have pets on the Premises, this Agreement and any Security Deposit shall be forfeited.
SMOKING POLICY. Smoking INSIDE OF THE SUITES IS PROHIBITED. There are ashtrays provided outside on the private deck of each Suite.

SUBLETTING. The guest does not have the right to sublet the Premises.
INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.
MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings.
TRASH. The Guests shall dispose of all waste material generated during the Lease Term under the strict instruction and direction of the Host.
QUIET ENJOYMENT. The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement and eviction. EVENTS BY CONTRACT ONLY -- events will be managed, staffed, and the Berry Hill Police Department will be notified prior to patrol the area. Guests must make arrangements for visitors totaling over 6 to 8 Guests and Visitors, and may not exceed 20 Guests/Visitors per Suite. Parking is limited and each Suite has 2 parking slots -- arrangements must be made for parking in neighboring lots and prohobited otherwise.
HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss -- from theft, vandalism, fire, water, rain, acts of God, interruptions of utilities, acts of others, or other causes whatsoever. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest. Also, Guest(s) is responsible for insuruing personal items and those of any occupants or people invited to your Suite -- Guest SHOULD INSURE HIS PROPERTY AGAINST ABOVE AND SIMILAR LOSSES INCLUDING PERSONAL LIABILITY, if such coverage is desired. Guest(s) agrees to be held liable for damages to your Suite and its contents that occurs during your stay, excluding normal wear and tear. If your actions or the actions of your party cause the WestWood Shed Suite or Suites to become uninhabitable, you agree to pay the cost to repair and the posted nightly rate until the Suite or Suites become habitable again.
ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this A greement.
USE OF PREMISES. This property is zoned Mixed-Use, allowing the Guest(s) to live and openly work from their Suite with limited use according to the Berry Hill Zoning Ordinances for District 1, on the street of Westwood Drive, see berryhilltn.org/105/Zoning District Map/Poster for limitations. No subletting of the premises or any part is permitted.
SIGNAGE. The Guest(s) shall be allowed to erect signs as specified by WestWood Shed Signage Guidelines and upon approval of the WestWood Haus Realty management team, at the Guest(s) expense and in accordance with the applicable laws and ordinances.
PROHIBITED CONDUCT. The Guest(s) or other visiting occupants of the premises, and visitors, invited or otherwise ("your party"), agree not to break the law or engage in activities that may disturb or threaten the rights, comfort, health, safety, or convenience of others, including WestWood Haus employees, building staff, building residents, or other WestWood Shed & Haus guests/visitors. Prohibited conduct includes, without limitations, the following activities: disrupting the WestWood Shed business operations; verbal or physical harassement; manufacturing, delivering, possessing with intent to deliver, or otherwise possessing a controlled substance or drug paraphernalia; engaging in or threatening violance; possessing a weapon prohibited by state law; discharging a firearem; displaying or possessing a gun, knife, or other weapon in the common area in a way that may alarm others; storing anything in utility closets or spaces in the building that house any gas appliances; tampering with utilities or telecommunications, including wireless access points and alarm systems; building hazardous materials into the apartment community; or taking any action that would injure or derogate from the WestWood Shed's reputation in any way, including making untrue allegatioins against the WestWood Shed to others, whether onlie or otherwise.
Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent.
The City of Berry Hill codes of conduct are detailed in the binder provided in the Suite, and outlined in breif below.
Short-Term Rental Property (STRP) occupants [ "Guests" and "Visitors" ] shall abide by all applicable Berry HIll ordinances and provisions of the Berry Hill Municipal Code, including without limitation:
a. Provisions regarding offenses against the Peace & Quiet
11-301. Disturbing the peace.
11-302. Anti-noise regulations.
Quiet Hours of 9:00 P.M. and 7:00 A.M.
b. Provisions regarding Trespassing, Malicious Mischief & Interference with Traffic
11-601. Trespassing.
[ No parking on neighbors lots without permission. Each Suite is allotted 2 parking slots on the WestWest Shed's property; any additional parking needed must be pre-arranged with WestWood Haus Realty. ]
11-602. Trespassing on trains.
11-603. Malicious mischief.
11-604. Interference with traffic.
c. Provisions regarding Obscenity, Morals
11-801. Disorderly houses.
11-802. Immoral conduct. [ Pornography Prohibited ]
11-803. Indecent or improper exposer or dress.
11-804. Window peeping.
d. Provisions regarding Refuse & Trash Disposal
17-101. Unlawful disposition.
17-102. Storage and disposition of residential refuse.
17-103. Storage and disposition of commercial and industrial refuse.
17-104. Nuisauces prohibited.
17-105. Abatement of nuisances.
EVENTS, by Contract Only. The WestWood Shed & Haus common areas are to be used and shared by guests and visitors, and no commercial, industrial or retail activity can be conducted unless authorized in writing by Lessor or Landlord. Guests must make arrengements for visitors totaling over 6 to 8 guests and visitors, and may not exceed 20 guests/visitors total inside of each Suite. Parking is limited and each Suite is limited to two (2) parking slots -- arrangements must be made for parking in neighboring lots and is prohibited otherwise. All events must be agreed upon with the Lessor/Landlord, UNDER CONTRACT, managed/staffed, and the Berry Hill Police Department will be notified prior to protrol the area. Any Event without prior written consent or contract will result in immediate eviction.
POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.
LIABILITY. Host, Owner or Agents of Host/Lessor shall not be liable for damages of losses to person or property of residents or invitees from theft, vandalism, fire, water, rain, acts of God, interuptions of utilities, acts of others, or other causes whatsoever. Guest/Lessee is responsible for insuring personal items and those of any occupants or people invited to your Suite -- GUEST/LESSEE SHOULD INSURE HIS PROPERTY AGAINST ABOVE AND SIMILAR LOSSES INCLUDING PERSONAL LIABILITY. Guest/Lessee agrees to be held liable for damages to your Suite and its contents that occurs during your stay, excluding normal wear and tear. If your actions or the actions of your party cause the Rental Suite(s), to become uninhabitable, you agree to pay the cost to repair and the posted nightly rate until the Rental Unit(s) becomes habitable again.
GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location, in the state of Tennessee, Davidson county.
DEFAULT. If Guest extends stay, and shall default in the prompt payment of rent, or the violation of any of the terms of this Agreement, Host may declare this Agreement immediately terminated, and enter and take possession of said Premise after the Host has given notice to Guest to vacate the Premise. Host may in such event re-rent the Premise and hold Host liable for any subsequent or consequent loss or damage. Guest agrees to pay on demand all expenses and reasonable attorney's fees Host incurs in the collection of said rent or enforcement of any of the provisions of this Agreement.
ACKNOWLEDGEMENT. Guest(s) hereyby acknowledges that they have read this Agreement, and the Guest(s) understands that the rules and regulations may be amended from time to time and are for the purpose of protecting the premises and providing for the safety and well being of all occupants of the premises, and affirms that Guest(s) will, in all respects, comply with the terms and provisions of this Agreement.

NOT APPLY TO SHORT-TERM RENTALS
LONG-TERM LEASE AGREEMENT ("Extended Agreement"). This marked section applies to Long-Term (28 days+) Stays, and must be SIGNED by the Guest ("Lessee") & RETURNED to the Host ("Lessor", WestWood Haus Realty, LLC) to TheWestWoodHaus@gmail.com or faxed to 615-297-0523 prior to a long-term stay.
ALL ABOVE SHORT-TERM RENTAL AGREEMENT TERMS APPLY to these additional Long-Term Lease Agreement terms.
EXTENDED LEASE TERMS. This is a MONTH-TO-MONTH Extended Agreement, beginning ________________________________________ (Check-In date)
and ending _____________________________________ (Check-Out date). At the expiration of this Extended Agreement/Lease, Guest(s)/Lessee will vacate the premises. Booking dates requested: {{reservation_date}}
EXTENDING TERMS. Following the specified Check-Out Date, if there are no future dates booked on this property, following the Check-Out date of this Rental Agreement, it may be arranged to keep an open-ended lease period, after giving fifteen (15) days written notice of intention to do so. In kind, at the option of the Host/Lessor, this lease may be renewed or terminated after giving with a fifteen (15) day written notice.
[ ___ ] The payment of the Security Deposit may remove the Suite from the rental market with a prior agreement.
RENTAL FEE. In consideration of said lease, Guest(s)/Lessee agrees to pay total RENT of ____________________________________ per month to Host/Lessor. All rent is due the same date each month following Check-In date -- Rent Due Date: ______________ day of each month. Any rent received after five (5) days of Rent Due Date will be considered late. This Rental Fee Rate is gauranteed for only the Extended Lease Terms, this Rental Fee Rate is not gauranteed after the above terms when Extending Terms. Notice will be given in writting fifteen (15) days or sooner, in advance of the Rental Fee Rate of any changes.
SERVICE CHARGE. Lessee agrees tthat a service charge in teh amount of ten percent (10%) of the monthly rental installment will be added to the monthly installment if the payment is not postmarked on or before the fifth (5th) day of payment due date.
RETURNED CHECKS. Returned checks are considered as unpaid rent and as such service fee of thirty-five dollars ($35.00) will be charged. A Late Fee/Service Charge will also apply if the payment is maded after the fifth (5th) day of payment due date.
SECURITY DEPOSIT. The Guest shall be obligated to pay the following amounts upon the execution of this Agreement:
Security Deposit amount as detailed in the booking process. The Security Deposit is for the faithful performance of the Guest under the terms and conditions of this Agreement, and is held as security against damage to the dwelling or the the premises including, but not limited to damage to furnishings (rugs, mattress, house-wares), floors, fixutures, doors, locks, windows, hardware, plumbing fixtures, appliances, exterior or interior walls, or appurtenances or of the dwelling or of the premises (normal wear and tear is expected). The Guest must pay the Security Deposit at the execution of this Agreement. The Security Deposit shall be returned to the after the end of the Lease Term less any itemized deductions -- after the dwelling has been vacated by the Guest and inspected by the Host, all as provided by the State of Tenneessee statue. This Security Deposit shall not be credited towards any Rent unless the Host gives their written consent.
DEPOSIT - EXTENDED AGREEMENT. Lessee agrees to deposit the Lessor upon execution of the Extended Agreement, receipt of which is hereby acknowledged the sum of One Thousand Dollars ($1,000). This deposit is held as security against damage to the dwelling or the the premises including, but not limited to damage to furnishings (rugs, mattress, house-wares), floors, fixutures, doors, locks, windows, hardware, plumbing fixtures, appliances, exterior or interior walls, or appurtenances or of the dwelling or of the premises (normal wear and tear is expected), and Lessee vacating the dwelling prior to termination date of this Extended Agreement, or failing to perform any and all covenants herein. Said deposit shall also be subject to terms and conditions of any executed security deposit policy. Deposit is neither an advance Rental Payment nor a BOnus to Lessor, and Lessor agrees that if all the covenants imposed upon Lessee have been filled, Lessor shall refund said deposit by mail, to the address furnished by resident, after the dwelling has been vacated by resident and inspected by Leesor, all as provided by State statue. Said deposit shall not earn interest and shall be deposited in the WestWood Hause, LLC bank account ast First National Bank of Middle Tennessee. Security Deposit details listed below.
UTILITIES. All water, electricity, and Internet service are included in the Rental Payment. If it is determinded that an excessive usage of utilities has been incurred by the Lessee, additional fees will be chareged.
DAMAGE TO DWELLING. Lessee agrees to pay Lessor any and all damage to the dwelling or the the premises within fourteen (14) days after written notice by Landlord specifying the breach and requesting that the Lessee remedy it with that period of time. The Landlord may enter the dwelling Unit and cause the work to be done in a workmanlike manner and submit in itemized bill fo the actual and reasonable value thereof as rent on the next date when periotic rent is due, or if the Extended Agreement has terminated for immediate payment.
This includes, but not limited to damage to furnishings (rugs, mattress, house-wares), floors, fixutures, doors, locks, windows, hardware, plumbing fixtures, appliances, exterior or interior walls, or appurtenances or of the dwelling or of the premises (normal wear and tear is expected). Lessee is responsible for damage caused by act of neglect of Lessee, Lessee's spouse, member of Lessee's family, guest, invites, or licensee of Lessee or person in the employ or under the control of Lessee.
NO NAILS or SCREWS may be put INTO THE WALLS. There are high pressured sprinkler system pipes, plumbing lines and electrical lines in the walls, these are all well mapped in the construction plans, and only the Landlord/Owners are allowed to do so. A request must be made, and a maintenance person will assist.
TERMINATION OF EXTENDED LEASE AGREEMENT. Lessee must give Lessor fifteen (15) days advance written notice of intent to vacate the Leased premises, and prior to vacating the dwelling all sums due to Lessor under the terms of this Extended Agreement must be paid. If premises are vacated proir to expiration of the full lease term, the security deposit shall be automatically forfeited, AND a termination payment equal to one month's rent must be paid to Lessor. Termination payment is not rent payment in any form. It strictly gives Lessee the right to terminate early.
ACKNOWLEDGEMENT. Guest(s)/Lessee hereyby acknowledges that they have read this Agreement, and the Guest(s)/Lessee understands that the rules and regulations may be amended from time to time and are for the purpose of protecting the premises and providing for the safety and well being of all occupants of the premises, and affirms that Guest(s)/Lessee will, in all respects, comply with the terms and provisions of this Agreement.

On Extended Lease Agreements:
SECURITY DEPOSIT DETAILS. In the event that the lease is not executed for any reason other than the Lessee's application not being approved by the Lessor, neither the deposit nor any portion of the deposit will be refunded.
Refund of the Security Deposit is made subject to, but not limited to the following provisions:
1. Full terms of the lease has expired.
2. Fifteen (15) days written notice was given prior to the vactating property.
3. No damage was caused to property beyond normal wear and tear.
4. Entire dwelling has been cleaned and left in state equal to the condition upon taking occupancy.
5. No holes or scratches on the walls.
6. No burns, holes or stains on carpets or floors.
7. No unpaid late charges or delinquent rents.
8. All keys and remotes have been returned.
9. All junk removed, debris and trash placed in proper containers.
10. All terms of the lease have been satisfied.
If the above conditions are not met, charges will apply fo the costs of labor and materials for repair(s), replacement, cleaning, and for delinquent payments. Lessee's liability for damages is not limited to the amount of the Security Deposit. In the event that repair or replacement costs resulting from damage exceed the deposit amount being held, Lessee is responsible for additional costs incurred by Lessor.
Security Deposits will be returned by mail to the forwarding address(es) privided.
Secirty Deposit checks will be issued to the oritinal provider of the check only within thrity (days of the lease expiration date.
